EmbroidMe Penrith Terms of Trade


Privacy Statement

For each visitor to our Web page, our Web server automatically recognizes no information regarding the domain or e-mail address. We collect the e-mail address of those who communicate with us via e-mail, aggregate information on what pages consumers access or visit, user specific information on what pages consumers access or visit and information volunteered by the consumer, such as survey information and/or site registrations.

The information we collect is used for internal review and is then discarded, used to improve the content of our Web page, used to customize the content and/or layout of our page for individual consumer and used by us to contact consumers for marketing purposes.

If you do not want to receive e-mail from us in the future, please let us know by sending an e-mail, calling or writing, and telling us that you do not want to receive e-mail from our company.

Terms of Use Statement

You understand and agree that the owners of this site shall not be liable for any direct, indirect, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, data or other intangible losses (even if the owners of this site have been advised of the possibility of such damages), resulting from the use or the inability to use the product(s) and or service(s) or any misuse of the product(s) and or service(s) in a manner not in accordance with their intended use.

Terms of Trade

1. GOODS

1.1 All goods will be described on any invoices, quotation, work orders by EmbroidMe Penrith to the Customer.

2. TITLE

2.1 It is the intention of EmbroidMe and agreed by the Customer that ownership of the Goods shall not pass until: 

(a) the Customer has paid all money owing for the particular Goods, and 

(b) the Customer has met all other obligations due by the Customer to EmbroidMe in respect of all contracts between EmbroidMe and the Customer; and 

3. PRICE AND PAYMENT

3.1 The cost will be as indicated on invoices provided by EmbroidMe Penrith to the Customer in respect of the Goods supplied. 

3.2 All orders under $250.00 are to be paid in full at time of order placed. All orders over $250.00 can be paid in full or a 50% deposit at time of order. 

3.3 Time for payment for the Goods shall be of the essence and will be stated on the invoice, quotation, or any other order forms. If no time is stated then payment will be due on pickup or as stated in 2.2.

3.4 The Price shall be increased by the amount of any GST and other taxes and duties which may be applicable, except to the extent that such taxes are expressly included in any quotation given by EmbroidMe. 

3.5 If a Customer Cancels a Job which Stock has been ordered & has arrived .They will incur the restocking , Delivery to & return delivery charges which EmbroidMe would incur. 

3.6 All BYO items are at own risk all care taken but no responsability

3.7 All Logo's EmbroidMe does remain the property of EmbroidMe The charge to setup is for time/labour spent . If you wish to own the file there is a cost of $200 + Gst

4. CONSEQUENCES OF DEFAULT & DEFAULT

4.1 There will be Interest on overdue invoices each day from the date when payment falls due, until the date of full payment, at the current rate of  (2.5%)  per calendar month ( It will be at EmbroidMe’s sole discretion such interest shall compound monthly at such a rate) before & after any judgment. 

 
4.2 When a Customer defaults in payment of any invoice when due, the Customer shall indemnify EmbroidMe Penrith from and against all costs and disbursements incurred by EmbroidMe in pursuing the debt including legal costs on a solicitor and own client basis and EmbroidMe Penrith collection agency costs.

5. PRIVACY ACT 1988

5.1 Customer agrees for EmbroidMe Penrith to obtain from a credit-reporting agency a credit report containing personal credit information about the Customer in relation to credit provided by EmbroidMe Penrith. 

5.2 Customer agrees that EmbroidMe Penrith may exchange information about the Customer with  credit providers named in any Application for Credit account or named in a consumer credit report issued by a reporting agency for the following purposes: 

(a) to assess an application by Customer,

(b) Notify other credit providers of a default by the Customer,

(c) Exchange information with other credit providers as to the status of this credit account, where the Customer is in default with other credit providers, and

(d) to assess the credit worthiness of Customer. 

5.3 Customer consents to EmbroidMe Penrith being given a consumer credit report to collect overdue payment on commercial credit 

(a)  As in the Privacy Act 1988 


5.4 The Customer agrees that Personal information provided may be used and kept by EmbroidMe Penrith for the following purposes and for other purposes as shall be agreed between the Customer and EmbroidMe Penrith or required by law from time to time:


(a) provision of Goods and/or Services,

(b) marketing of Goods and/or Services by EmbroidMe Penrith, its agents or distributors in relation to the Goods and/or Services,

(c) analysing, verifying and/or checking the Customer’s credit, payment and/or status in relation to the provision of Goods and/or Services, 

(d) processing of any payment instructions, direct debit facilities and/or credit facilities requested by Customer, and 

(e) enabling the daily operation of Customer’s account and/or the collection of amounts outstanding in the Customer’s account in relation to the Goods and/or Services. 


5.5 EmbroidMe Penrith may give, information about the Customer to a credit reporting agency for the following purposes: 

(a) to obtain a consumer credit report about the Customer , and or 

(b) allow the credit reporting agency to create or maintain a credit information file containing information about the Customer.

6.Artwork
6.1 All Artwork remains the property of EmbroidMe Penrith .The fee that is charged is to cover the time to creat the design & storage of all files for when the job is needed to be done again

6.2 Screen Printing films and screens are kept for 14 months, as they do perish. If a job is needed again after this time new screen charges apply. Also any alterations to existing screens, a new screen charge will need to be applied.

7.REFUNDS

7.1 In the event of a Refund needed it will be refunded in the manner of which it was paid for unless it was large cash amounts as we don't keep cash onsite so other options can be arranged .
